Competition Terms and Conditions

  1. The Promoter
    1. The promoter is: Gemfields Limited of 1 Cathedral Piazza, London SW1E 5BP.
  2. The competition
    1. The title of the competition is Visit the Mine: VISIT THE SOURCE OF 500 MILLION YEAR OLD EMERALDS.
    2. The competition is only open to those individuals who are either:
      1. registered attendees of the Introductory Course in Emeralds, Rubies and Sapphires run by the Promoter at the The Ham Yard Hotel, 1 Ham Yard, Soho, London W1D 7DT on Sunday 6 October 2019 (the “Introductory Course”); or
      2. individuals who are in the jewellery sales industry and a colleague or a peer of a registered attendee of the Introductory Course, and who are one of the first two individuals nominated by the registered attendee by written notice to the Promoter, and are not members of the immediate family or household of the registered attendee,

provided that in each case the individual (i) has completed the registration form for the competition at and agreed to these terms and conditions; and (ii) has followed the @Gemfields Instagram account. Each individual who complies with this paragraph and is also is eligible under paragraph 4 below shall be an “Eligible Participant”.

      1. The winning entry in the competition will be that single entry submitted by a single Eligible Participant, which records the following sale:
        1. a sale by the Eligible Participant of a single piece of jewellery with the centre stone being an emerald, ruby, or sapphire, or a piece of jewellery featuring multiple emeralds, rubies or sapphires (the “Jewellery Piece”);
        2. the sale must be to a genuine retail customer in the course of the Eligible Person’s employment by a jewellery retailer, and the Eligible Person must be directly and solely responsible for the sale;
        3. the sale must occur during the Sale Period (the “Sale Period“ shall be that period starting at the later of (i) the time that the individual becomes an Eligible Participant under paragraph 2.2 above, or (ii) 12am on 7 October 2019; and finishing at 11:59pm on 31 December 2019), and full payment for the purchase of the Jewellery Piece must be received by the jewellery retailer who employs the Eligible Participant within the Sale Period; and
        4. the sale must be for the highest sale price in pounds sterling (GBP) amongst all valid entries which have been submitted by Eligible Participants in the competition.
      2. Each registered attendee of the Introductory Course may by written notice to the Promoter nominate up to two colleagues or peers who are in the jewellery industry (provided they are not members of the immediate family or household of the registered attendee) to also participate in the competition. If the registered attendee nominates more than two (2) colleagues or peers only the first two nominees will be eligible.
  1. How to enter
    1. All competition entries must be received by the Promoter at the address set out at paragraph 1 by no later than 6pm GMT on 1 January 2020 (the “Closing Date”). All competition entries received after the Closing Date are automatically disqualified.
    2. To enter the competition you must before the Closing Date send an email to which includes your name, your address, your telephone number, your email address, and your Instagram handle, and includes particulars of the sale, namely a description of the Jewellery Piece, the sale price and the date on which the sale took place. Without prejudice to the Promoter’s rights in paragraph 4.2 below, you must attach to the email written confirmation from a director of the jewellery retail company which employs you confirming that the particulars of sale are correct.
    3. There is no charge for you to enter this competition or to attend the Introductory Course, or for you to follow the Promoter on Instagram.
    4. The Promoter will not accept:
      1. responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of posting or transmission as proof of receipt of entry to the competition.
    5. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
  2. Eligibility
    1. The competition is only open to all residents in the UK aged 18 years or over and who comply with paragraph 2.2 above, except:
      1. employees of the Promoter or its holding or subsidiary companies;
      2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
      3. members of the immediate families or households of (a) and (b) above.
    2. In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition, or to verify the particulars of the sale of the Jewellery Piece. Such proof may include you providing the Promoter with documentation to verify the nature of the Jewellery Piece, the value of the sale, and the identity of the customer in the sale.
    3. The Promoter will not accept competition entries that are:
      1. automatically generated by computer;
      2. completed by third parties or in bulk;
      3. illegible, have been altered, reconstructed, forged or tampered with;
      4. photocopies and not originals; or
      5. incomplete.
    4. There is a limit of one entry to the competition per person. If a person makes more than one entry to the competition, only the first entry will be valid. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    5. The Promoter will not accept any more than one entry to the competition relating to the sale of any one particular Jewellery Piece. If there are multiple entries covering the sale of a particular Jewellery Piece, the Promoter may at its absolute discretion: (i) disqualify all entries relating to that Jewellery Piece; or (ii) determine which Eligible Person is directly and solely responsible for the sale of the Jewellery Piece.
    6. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
    7. Competition entries cannot be returned.
  3. The prize
    1. The prize is a trip for two (2) people as follows:
      1. return business class air travel from London to Johannesburg, return standard class air travel from Johannesburg to Ndola, Zambia, and domestic flights within Zambia at a total cost (for all flights) of no more than US$10,000;
      2. two (2) nights accommodation at the mine camp at the Kagem emerald mine near Ndola in Zambia,
      3. two (2) nights accommodation in one deluxe room at the Royal Livingstone hotel at Victoria Falls in Zambia; and
      4. food and beverage not exceeding $200 per person per night while at the Royal Livingstone hotel.
    2. The timing of the trip will be determined by the Promoter in consultation with the competition winner, and the dates cannot be changed once they have been set. The trip must be taken before 1 November 2020.
    3. Except as noted above, the prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.
    4. You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified, and have had all necessary vaccinations.
    5. The prize is subject to availability. There is no cash alternative for the prize.
    6. The prize is not negotiable or transferable, and cannot be resold.
    7. The winner will be accompanied by at least one employee of the Promoter or one of its holding or subsidiary companies for the duration of the trip.
  4. Winners
    1. The decision of the Promoter is final and no correspondence or discussion will be entered into.
    2. The Promoter will contact the winner personally as soon as practicable after the Closing Date, using the telephone number or email address provided with the competition entry.
    3. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter may publish the name and county of the prize winner and, the sale price of the Jewellery Piece applicable to their entry in the competition. The Promoter may also make this information available to any other person who requests it.
  5. Claiming the prize
    1. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within thirty (30) days of the Closing Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
    2. The Promoter does not accept any responsibility if you are not able to take up the prize.
  6. Limitation of liability
    1. Insofar as is permitted by law, the Promoter, its holding company, its subsidiary companies, and its agents and distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize, except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
    2. The winner is responsible for arranging all necessary travel insurance for themselves and their guest.
  7. Data protection and publicity
    1. The Promoter will only process your personal information as set out in its privacy policy here: See also paragraph 6, with regard to the announcement of winners.
  8. General
    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    3. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or any other social network. You are providing your information to the Promoter and not to any other party.
    4. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
